This Privacy Policy applies to affiliate applicants, approved affiliates, and users of the KiWAV affiliate portal.

When you apply to or participate in the KiWAV Affiliate Program, we may collect the following types of information:

3. Affiliate Tracking and Cookies

The Program uses affiliate tracking technology to identify referrals and attribute qualifying purchases to affiliates.

This may include cookies, tracking links, referral codes, coupon codes, order attribution data, and related tracking tools.

The affiliate tracking cookie duration is 30 days unless otherwise stated in the affiliate dashboard or Program settings.

Tracking may not work properly if a customer blocks cookies, uses certain browser privacy settings, clears cookies, uses ad blockers, switches devices, or if the order is not properly attributed by the affiliate tracking system.

4. Third-Party Service Providers

We may use third-party service providers to operate and manage the Program.

These providers may include affiliate tracking software, ecommerce platforms, payment processors, email providers, analytics tools, fraud prevention tools, accounting services, and other business service providers.

For example, affiliate registration, tracking, dashboard access, and commission records may be processed through GoAffPro or similar affiliate management software.

Payment information may also be processed through third-party payment providers such as PayPal or other approved payment methods.

These third-party providers may process information according to their own privacy policies and service terms.

5. Payment and Tax Information

To process affiliate payments, we may collect or request payment details such as your PayPal email address or other approved payment information.

Where necessary, we may request tax, identity, invoice, or compliance information before issuing payment.

Affiliates are responsible for providing accurate and up-to-date payment and tax information.

We are not responsible for payment delays, failed payments, or incorrect payments caused by inaccurate, incomplete, or outdated information provided by the affiliate.

• ecommerce platform providers;
• payment processors;

• fraud prevention or security service providers;
• government, regulatory, tax, law enforcement, or legal authorities when required by law;
• business partners or service providers who help us operate the Program.

We may also share information when necessary to protect the rights, property, security, or interests of KiWAV, our customers, affiliates, or the public.

7. Data Retention

We retain affiliate information for as long as necessary to operate the Program, manage affiliate accounts, process commissions and payments, maintain business records, resolve disputes, prevent fraud, comply with legal obligations, and enforce our Program terms.

If your affiliate account is rejected, suspended, terminated, or inactive, we may still retain certain information where necessary for recordkeeping, compliance, fraud prevention, dispute resolution, accounting, or legal purposes.

8. Security

We take reasonable measures to protect affiliate information from unauthorized access, misuse, loss, disclosure, alteration, or destruction.

However, no method of online transmission, electronic storage, or internet-based service is completely secure. We cannot guarantee absolute security of any information transmitted or stored through the Program.

Affiliates are responsible for keeping their login credentials secure and for notifying us promptly if they believe their account has been accessed without authorization.

9. International Data Transfers

KiWAV is based in Taiwan and works with service providers that may operate in other countries or regions.

By applying to or participating in the Program, you understand that your information may be processed, stored, or transferred outside your country or region, including to countries that may have different data protection laws.

10. Your Choices and Rights

Depending on your location and applicable law, you may have rights regarding your personal information, such as the right to request access, correction, deletion, restriction, or objection to certain processing.

You may also update certain account and payment information through the affiliate dashboard, where available.

11. Communications

We may send emails related to your affiliate account, application status, referral activity, commission status, payments, Program updates, policy changes, or other Program-related matters.

Some Program-related communications are necessary for participation in the Program and may not be optional.

Affiliate links, dashboards, emails, or Program materials may contain links to KiWAV websites or third-party websites.

This Privacy Policy does not apply to third-party websites or services. We are not responsible for the privacy practices, content, or security of third-party websites or services.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, with or without prior notice, where permitted by applicable law.

When we make changes, we may update the “Updated” date at the top of this page.

Your continued participation in the Program after changes are posted or made available means you acknowledge the updated Privacy Policy.

These KiWAV Affiliate Program Terms and Conditions (“Terms”) govern your participation in the KiWAV Affiliate Program (“Program”). By applying to or participating in the Program, you agree to follow these Terms.

“KiWAV,” “we,” “us,” or “our” refers to KiWAV Motors. “Affiliate,” “you,” or “your” refers to the person, business, website, creator, publisher, or organization participating in the Program.

1. Program Overview

The KiWAV Affiliate Program is a commission-based referral program.

Approved affiliates may promote KiWAV products using approved affiliate links, referral links, or coupon codes provided through the affiliate dashboard.

When a customer makes a qualifying purchase through your approved affiliate link or coupon code, you may earn a commission, subject to these Terms.

2. Application and Approval

All affiliate applications are subject to review and approval by KiWAV.

We may accept or reject any application at our discretion. We may also suspend, block, or terminate any affiliate account if we believe the affiliate is unsuitable, inactive, misleading, abusive, or in violation of these Terms.

You must provide accurate and up-to-date information when applying and while participating in the Program.

Only approved affiliates may access the affiliate dashboard and use affiliate tracking links or coupon codes.

3. Suitable Affiliates

The Program is intended for motorcycle-related content creators, websites, reviewers, bloggers, riding communities, motorcycle forums, social media creators, builders, repair and maintenance creators, and other relevant publishers.

KiWAV may reject or remove affiliates whose websites, accounts, or promotional activities include or promote:

• illegal activities;
• sexually explicit, violent, hateful, defamatory, discriminatory, or misleading content;
• spam, fake traffic, bot traffic, or deceptive marketing;
• trademark abuse or impersonation;
• coupon scraping, unauthorized coupon promotion, or low-quality coupon directory behavior;
• content that may damage the reputation of KiWAV or its products.

4. Affiliate Links and Tracking

Affiliates must use only the approved affiliate links, referral links, or coupon codes provided in the affiliate dashboard.

KiWAV is not responsible for commissions that are not tracked due to incorrect link usage, browser settings, ad blockers, cookie restrictions, technical errors outside our control, or failure to use approved tracking links.

The affiliate tracking cookie duration is 30 days unless otherwise stated in the affiliate dashboard.

If multiple affiliates refer the same customer, the commission attribution will be determined by the affiliate tracking system.

5. Commission Rate

The commission rate is shown in the affiliate dashboard or otherwise communicated by KiWAV.

KiWAV may update commission rates, eligible products, excluded products, or commission rules at any time. Any changes will apply to future orders after the change becomes effective, unless otherwise stated.

6. Commission Calculation

Commissions are calculated on approved net product sales only.

Commissions are not calculated on shipping fees, taxes, VAT, duties, handling fees, gift cards, store credit, payment processing fees, or any non-commissionable amount.

If a discount, coupon, automatic store discount, refund, partial refund, cancellation, return, chargeback, or order adjustment applies, the commission may be reduced, reversed, rejected, or adjusted accordingly.

7. Qualifying Purchases

A qualifying purchase occurs when:

1. a customer clicks your approved affiliate link or uses your approved affiliate coupon code;
2. the order is properly tracked by the affiliate system;
3. the order is paid for by the customer;
4. the order is not cancelled, returned, refunded, charged back, or determined to be invalid;
5. the purchase complies with these Terms.

Only qualifying purchases are eligible for commission.

8. Non-Commissionable Orders

No commission will be paid for:

• personal purchases made by the affiliate through their own affiliate link or coupon code;
• orders placed by the affiliate for themselves, friends, relatives, employees, business partners, or related parties;
• orders placed for resale or commercial redistribution;
• orders that are cancelled, returned, refunded, partially refunded, charged back, failed, fraudulent, or rejected;
• orders that are not properly tracked;
• orders using unauthorized coupons, leaked coupons, or coupon codes not approved for affiliate use;
• orders generated through spam, fake traffic, bots, forced clicks, misleading links, or deceptive practices;
• orders generated through prohibited paid search activity;
• any order KiWAV reasonably determines to be invalid, abusive, or in violation of these Terms.

9. Commission Review and Approval

All commissions are initially subject to review.

Commissions are reviewed 90 days after the order date to account for returns, refunds, cancellations, chargebacks, partial refunds, and other order adjustments. Approved commissions are paid monthly once the affiliate’s approved balance reaches USD $50.

Pending commissions are not payable until they are approved.

Balances below USD $50 will roll over to the next payout cycle.

KiWAV reserves the right to reject, reverse, adjust, or offset commissions for orders that are later cancelled, returned, refunded, charged back, modified, or determined to be invalid.

10. Payment Terms

Payment will be made through the approved payment method provided by the affiliate, such as PayPal or another payment method accepted by KiWAV.

Affiliates are responsible for providing accurate and up-to-date payment information. KiWAV is not responsible for payment delays or failed payments caused by incorrect, incomplete, or outdated payment information.

Any bank fees, PayPal fees, currency conversion fees, intermediary bank fees, or receiving fees may be the responsibility of the affiliate.

11. Taxes

Affiliates are responsible for reporting and paying any taxes, duties, fees, or other obligations related to commissions received through the Program.

KiWAV may request tax, identity, or payment information where necessary for payment processing, accounting, compliance, or legal purposes.

12. Promotional Guidelines

Affiliates may promote KiWAV products through websites, blogs, YouTube, social media, forums, email newsletters, riding communities, product reviews, installation guides, and other approved content channels.

Affiliates must present KiWAV products honestly and accurately.

Affiliates must not:

• make false, exaggerated, or misleading claims;
• promise fitment unless the fitment is verified;
• misrepresent product specifications, compatibility, materials, warranty, shipping time, or availability;
• imply that they are an employee, distributor, official representative, or customer service agent of KiWAV;
• copy KiWAV website content in a misleading or unauthorized way;
• use KiWAV branding in a way that may confuse customers;
• promote unauthorized discounts, fake coupons, or expired offers.

13. Fitment and Product Claims

Motorcycle fitment can vary by model year, market, trim, handlebar setup, adapter, modification, and installation condition.

Affiliates must not make absolute fitment claims unless the fitment has been clearly confirmed by KiWAV or by official product information.

Recommended wording includes phrases such as:

• “Please check the product page for fitment details.”
• “Fitment may vary by model year and setup.”
• “Check thread size, mounting style, and adapter requirements before ordering.”

14. Paid Advertising and Search Rules

Affiliates may not bid on KiWAV brand terms, trademarks, misspellings, domain names, product names, or confusingly similar keywords in paid search advertising without written permission from KiWAV.

Affiliates may not run ads that direct-link to KiWAV using affiliate links without written permission.

Affiliates may not create ads, domains, landing pages, or social accounts that may mislead customers into believing they are official KiWAV properties.

15. Coupon and Deal Site Restrictions

Affiliates may not post KiWAV coupon codes on coupon websites, deal websites, browser extensions, cashback platforms, loyalty platforms, or discount directories unless specifically approved by KiWAV in writing.

Affiliates may not promote unauthorized coupon codes, leaked coupon codes, expired coupon codes, or codes not assigned to them.

KiWAV may reject commissions generated through unauthorized coupon activity.

16. Disclosure Requirements

Affiliates must clearly disclose their affiliate relationship when promoting KiWAV products, affiliate links, or coupon codes.

Disclosures must be clear, easy to notice, and placed near the affiliate link or recommendation where required by applicable law, platform rules, or advertising guidelines.

Examples may include:

• “This post contains affiliate links.”
• “I may earn a commission if you purchase through this link.”
• “As a KiWAV affiliate, I may earn from qualifying purchases.”

17. Use of KiWAV Content and Branding

KiWAV may provide affiliates with approved digital marketing assets such as product images, banners, text links, logos, or product information.

Affiliates may use these materials only for the purpose of promoting KiWAV products through the Program.

Affiliates may not alter, misuse, resell, redistribute, or claim ownership of KiWAV content, product images, logos, trademarks, or brand assets.

All KiWAV trademarks, product images, text, logos, and brand materials remain the property of KiWAV.

18. Customer Relationship

Customers who purchase from KiWAV are customers of KiWAV.

All pricing, product availability, shipping, returns, warranty, customer service, and order policies are controlled by KiWAV and may change at any time.

Affiliates may not handle customer service on behalf of KiWAV unless specifically authorized in writing.

19. Account Suspension and Termination

KiWAV may suspend, block, or terminate an affiliate account at any time if we believe the affiliate has violated these Terms, acted in bad faith, generated fraudulent or low-quality traffic, misused KiWAV branding, promoted misleading claims, or harmed the KiWAV brand.

Either party may end participation in the Program at any time.

After termination, the affiliate must stop using KiWAV affiliate links, coupon codes, logos, images, banners, and promotional materials.

Commissions generated before termination may be reviewed and paid if they are valid, approved, and in compliance with these Terms. KiWAV may withhold, reject, reverse, or offset commissions related to violations, refunds, returns, fraud, chargebacks, or invalid orders.

20. Program Changes

KiWAV may modify, suspend, or discontinue the Program at any time.

KiWAV may update these Terms, commission rates, cookie duration, payment rules, promotional restrictions, product eligibility, or affiliate requirements at any time.

Continued participation in the Program after changes are posted or communicated means you accept the updated Terms.

21. Limitation of Liability

KiWAV is not responsible for indirect, incidental, special, consequential, or lost-profit damages related to participation in the Program, affiliate tracking, website downtime, technical errors, payment delays, rejected commissions, or termination from the Program.

The Program is provided on an “as available” basis. KiWAV does not guarantee uninterrupted tracking, sales volume, earnings, traffic, conversion rates, or commission results.

22. Independent Contractor Relationship

Affiliates are independent contractors.

Nothing in these Terms creates an employment, partnership, joint venture, franchise, agency, distributor, or sales representative relationship between the affiliate and KiWAV.

Affiliates have no authority to make promises, warranties, offers, statements, or commitments on behalf of KiWAV.

23. Governing Law

These Terms are governed by the laws of Taiwan, unless otherwise required by applicable law.

Any dispute arising from the Program shall be handled by the competent courts of Taiwan, unless otherwise required by applicable law.
